Notice of the Government Information and Government Affairs Disclosure Office of the General Office of the State Council on Centralized Disclosure and Dynamic Updates of Regulations

General Offices of the People’s Governments of all provinces, autonomous regions, and municipalities directly under the Central Government, General Offices (Offices) of Ministries and Commissions of the State Council, and General Offices of directly affiliated agencies:

The Fourth Meeting of the National Leading Group for Government Affairs Disclosure and the “Notice of the General Office of the State Council on Printing and Distributing the Key Points of Government Affairs Disclosure in 2021″(Guo Ban Fa [2021] No. 12) requires that local governments and State Council departments with rule-making power should collectively disclose the current effective regulations of their regions and departments through the “Government Information Disclosure Column” of the government portal website before the end of 2021. In order to strengthen work standards and improve the quality and effectiveness of centralized disclosure of regulations, we have consulted the General Office of the Ministry of Justice and hereby notified the following matters on relevant matters.

1. When rules are formulated or revised, they shall be announced by signing an order by the main person in charge in accordance with the provisions of the Regulations on Procedures for the Formulation of Rules. When regulations are publicly disclosed in a centralized manner, only the title, caption and main text are disclosed, and orders signed by the person in charge are not repeated. The caption should include identifying information such as publication time and document number, revision time and document number, and implementation time. For details, please refer to the caption format of the “Administrative Regulations Library” of the China Government Legal Information Network (website of the Ministry of Justice).

2. In order to improve the authority and standardization of the centralized disclosure of regulations and facilitate the public to better use the text of regulations obtained through the Internet, we have consulted the General Office of the Ministry of Justice and the China Government Network Operation Center to design the website layout and download layout of the regulations. At the same time, the page design of the “Government Information Disclosure Column” has been adjusted accordingly and is now issued together.

3. It is necessary to strengthen work coordination, coordinate legal work agencies to carry out joint work, do a solid job in cleaning up the rules and regulations system, and lay a solid foundation for the centralized disclosure of regulations. It is necessary to strengthen management after disclosure and establish a dynamic update mechanism so that the results of centralized disclosure of regulations can continue to play a role.

4. The general offices of the people’s governments of all provinces (autonomous regions and municipalities directly under the Central Government) shall guide the offices of the people’s governments of cities and autonomous prefectures divided into districts to do a good job in centralized disclosure of regulations in accordance with the requirements of this notice, and in the “Government Information Disclosure Column” on the portal website of the people’s governments of provinces (autonomous regions and municipalities directly under the Central Government), centrally display the regulations of the people’s governments of provinces (autonomous regions and municipalities directly under the Central Government) and the regulations of the people’s governments of cities and autonomous prefectures divided into districts.

V. The centralized publicity of rules and regulations is an important part of deepening the openness of government affairs and strengthening the management of government information. It is one of the key tasks in implementing the central documents such as the Construction Plan of China ruled by law (2020-2025) and the Implementation Outline for the Construction of a Government ruled by law (2021-2025). It is related to optimizing the business environment and promoting the modernization of the national governance system and governance capacity. It is necessary to raise awareness, strengthen leadership, implement all tasks strictly in accordance with requirements, ensure that tasks are completed on schedule, and provide the society with current and effective regulations with unified format, complete content, authoritative and standardized text.
